  • PPI with Advantage Finance

    Hey all,
    I took a loan out to buy a car with Advnatage Finance ( i wont mention that the guy put the price of the car up as he spoke to the loan company for me dodgey as hell!!)

    Unfotunatley i was only 19-20 at the time of buying so My father signed the guarentee for me, even though all i've ever had was a really bad photo copy of the agrement, somehow I had everysingle piece of insurance possible....accept NON of it covers ME although my dad is only the guarentoor.....?

    So I was for about 2 years, paying this without knowing until i broke my ankle couldn't pay them and no insurance although i was paying.
    After i recoverd went back to work i wrote a nice letter asking them to canx, after a long drawn out battle of about 5-6months they finaly said they would cancel some of them becuase they can't cancel some or somthing like that, so i apparently had about 6months worth of ppi back which was about 75-80 a month.

    Apart from the obvious is any of the above, dodgey, illegal or claimable, what i want to know is where should that "PPI refund have gone" to me personally? back to my loan account?

    Anyway please please help im sick of comercialised people/companies taking the michael out of me! Also anybody had dealings with this company??

    The PPI would come from your loan and the loan should have been recalculated at that time, you have anything in writing from then ?

    Whats the status of the loan now and are you trying to reclaim the rest of the PPI ? (I guess theres the first year and a half still to claim)

      Thanks, I do know how busy you guys are so appreciate the posts when you have the time,
      I've drafted up a little letter, with the points that are available, Ive just added one of my own not from the list.

      the Loan status is still ongoing, Im still paying for the car, and the payments have gone up to £200 a month from the standard £175 i was paying when i started the policy. Thinkin about it i must have had this loan since 2007/2008 i took it out in March that year anyway so a good 3 years now.

      I cannot for the life of me remember how i was told about having that small refund probably letter, and phone. Ill try find it, but have recently moved house.

      I have tried to canx all insurances as none cover me. but apparently i cannot do that only certain ones can be canx.....

      Is it also correct that they can charge me £7 a phone call and around £13 for a letter and £1.50 each transaction they put through.

      Instead of posting the whole letter up ill just post the points im putting to them.

      • it was stated / implied that taking out the policy would assist in my application for credit.
      · your agent was so pushy in selling me the policy so that I felt I had to accept.
      · your agent did not advise me that the policy was only optional
      • your agent did not provide me with the full information as to what the policy would and would not cover.
      • having recently looked at the paperwork for our loanI have noticed that only name of person covered is fully covered by the policy and name of person not covered is either not entitled to claim for all sections of the policy or is not covered at all, when I was informed / led to believe that all parties were equally entitled to the insurance cover.
      • having recently looked at the paperwork for my loanI now realise that I have been paying for insurance that I did not know I had taken out so could not have been explained to me.
      • You have also informed me once that I will received some small refund covering a couple of months insurance payment, I have NEVER received proof of Canx, I’ve never seen any of the money, and payments where raised rather than lowered although the policy should be costing less.

        I would send a SAR and find out exactly what is going on with this.
        It seems strange your payments went up and the only reason this could happen imo is if they gave you a new contract to sign at the time they repaid your PPI.

        Hopefully when you have this it will throw a light on the PPI repayment and everything else that has gone on with your account.

            I hope this link works cause it did for me lol, all the info and the letter is there for you.
            I would hang fire with your letter to see what has gone on with your account if i were you, but that's up to you.

                    SAR - Get your information under the Data Protection Act
                    There is a general right of access by a data subject to the personal data held about the data subject by the data controller. The process by which this right is exercised is called a ‘Subject Access Request’ (often abbreviated to SAR). The Act describes how the data controller must respond to such requests when an exemption does not apply. A company has 40 calendar days in which to provide the requested data, if no exemption applies.

                    You can read the Data Protection Act here ( Data Protection Act 1998 (c. 29) )

                    Here is a letter to be used when requesting personal information about you by any company.

                    Any past names/addresses

                    You will need to SAVE the letter to your computer before you will be able to make changes. You can open it in Open Office or Microsoft Word.

                      Thanks for that Im on it today, will get the written out and sent / Is the ODT file openable in Word doesn't seem to work, but im guessing its the same as what you posted so i can just copy and Paste.

                      Just out of the smallest interest, what would happen if they where to say they can't find paper work, as the only thing i've got really is an ineligable black photocopy of a contract or somthing with fees on i can't even read properly.

                            LOl that maybe all they have to send but cross that bridge when you come to it.
                            Really think you need to know when and why your payments changed and how many charges they have added to the account etc. This should all come to light with the SAR hopefully and also how much PPI you have paid and how much they paid you back.
