Missus has raised a question which I cant really answer, so big shout out on the bongos........................
Can anybody give advice on the following. The wife had a Cahoot loan account which over the term she has received several late payment charges of £30. In total adds up to about £400 worth. Now she is proficient in the reclaim process under normal circumstances and so can try and claim these back.
However, the loan eventually defaulted and she managed to scrap together enough money when they started getting heavy to pay off the balance, although the balance she paid was a SHORT PAYMENT (which Im sure many of you are already aware is a figure agreed to settle the debt at a much reduced amount.)
Now the question is, If she settled this debt at a reduced amount ie the full amount was not completely cleared. Is she now entitled to claim back her charges which she incurred throughout this debt.
I personally wouldve thought perhaps not as effectively some of these charges would not actually have been paid by her due to the short settlement.
Any thoughts. ?
