  • Hardship Cases - NEW CLAIMANTS - waiver until July 2009

    This is a simple guide to reclaiming charges if you are in financial difficulty - if you are starting from the beginning.


    WHAT IS HARDSHIP ?
    Hardship is if you are not able to meet your basic needs with the money you have coming in, if you are facing repossession, consequences from non payment of council tax/fines, or your income has recently fallen by over 45%, or if you live solely on benefits.




    The main points are in the STEP BY STEP guide, this is a simple outline.


    1) obtain your statements or transaction lists for the history of your account from your bank - use the Data Protection Act Subject Access Request letter to do this. Legal Beagles - SAR

    2) input all your figures on the simple interest spreadsheet Legal Beagles - Spready

    3) send your preliminary request for repayment letter Legal Beagles- Prelim Letter and include in it the paragraph about hardship and a basic outline of your circumstances.

    4) You should receive a letter back from the bank telling you about the test case. This MAY include an income/expenditure form IF they have looked at your hardship request. If so complete that, attach evidence as requested and return to the bank. If they havent then write back to the bank reiterating your request and concentrate on the hardship aspect of your claim.

    5) Give them a couple weeks and then telephone the bank to check they are dealing with your claim.

    The most widely used form is the MAT/BBA Common Financial Statement - which you can download an excel version from Money Advice Trust - The CFS budget forms and preparing a financial statement
