  • Deal defeated

I have now received my £324 cheque from DEAL ( cheque actually from CEL so shows they are the same company ) which are my costs awarded by the Judge two weeks ago. I never expected them to pay up thinking that they would have no interest in having a CCJ against them. The costs cover 18 hours of my time wasted on dealing with this organisation trying to take me to court for a parking matter.
Now I have succeeded with that I am now going to attempt to get them listed as being a " vexatious litigant " and/or have a Civil Restraint Order made against them, which would prevent them wasting any more of the Courts' time.

If anyone would like advise on how to get DEAL to pay costs, dont hesitate to contact me. The Judge was actually keen for me to claim a higher figure.

The C0-op probably no longer interested, I think I am correct in thinking the Co-op got rid of CEL/DEAL quite some time ago for reasons that are on the forums somewhere.

Hi. Is there a reason given why your case has been discontinued, I assume your letter is an official communication from the court ie an order striking out your case. I think I was lucky in getting my costs from them but my case was struck out because they didnt pay the hearing fee which I think has to be paid quite a bit in advance of the hearing. My hearing was listed for 10/4; they were told they had to pay the fee by 5/3, they didnt so the case was struck out on 9/3. On the form I had copied to me by the court, N173 Notice to Pay Fee it states " you (DEAL) will be liable for the costs which the defendant has occurred".......... that is wording that I used in my letter to the court which led to my costs hearing on 22/4, they paid up the £324 yesterday, which was quite a surprise. A very dubious lot, on the day of my costs hearing I received a letter saying their costs for turning up would be some ludicrous amount of money then 2 hours later they rang to say they were just about to set off for the hearing but would I like to accept £80 to not turn up at court. Of course they never turned up.
Might be a good idea to call in at your court office, I found mine very helpful. I think your case may be similar, the fact that it was struck out so close to your hearing date would suggest non payment of fees, by them.
Hope that helps a little, I claimed at the rate of 18 hours at £18 an hour. Good luck.

It's a letter from DEAL stating they have discontinued the claim against me and also informed the court. Obviously I'm not taking that as official so I'll still be going on Tuesday in case the court do not have a copy and for some bizarre reason DEAL do turn up.
I want to claim costs against them once this is over on Tuesday, how did you file for costs?

Sorry just read yours again! I'll ask the courts on Tuesday how to go about it

Yes glad you are still going to turn up. It all sounds dubious on their part, am sure only the court can halt a court hearing. Think Def you need to ascertain whether they have paid the fee.
