  • Hi everyone!

    I found this site through Martins MT and so glad I did as everyone seems really friendly and helpful. I will get straight to the point as I dont want to waste anyone's time. I breached the terms of a consent order and my ex went straight back to court to obtain an interim charging order. Went to court on Friday for the final charging order, which was granted. My ex has a good solicitor but I cant afford representation. We were in there less than 5 minutes and I was only asked by the judge if I owed the money (6k)which I said I did. I did say that I had written to his solicitor offering a monthly payment but it had been refused. He was not interested, and he then started talking to the solicitor regarding costs addressing her by her christian name like they were old friends. I cannot afford a solicitor and I dont know where to go from here. I've tried searching the net for info but cant understand the jargon anyway! Thank you so much for taking the time to read this.

    We'll need some back ground info on that sentence to help you more.

    I'm guessing you owe money to your ex partner and he has gone to court and sought a charging order secured against your 'own'(?) home??

        Sorry Celestine, but writing was never my strong point! Bought my house in 93. He moved in sometime later. Divorced in 2009 after 6 yrs although he started proceedings as soon as he left me in 2007 for his new skirt! I had to give him 6k at the time and 6k two years later (Sept 11). My solicitor was inexperienced and,i did explain that i would not be able to produce the 2nd lot of money as i would not be able to raise this and her words were " you cant say that, you have to offer something". I had been suffering depression since he left and i never saw him again (until court in 09) It was if I had died to him. I have no family apart from a wonderful daughter (mine) and cannot afford a solicitor. I have been diagnosed with Tri-geminal Neuralgia after being referred to the Neurologist in Sept 11 and I am starting back to work this afternoon after being on sick leave since August. I have a wonderful manager who has given me a post on a palliative care unit (something i have always wanted to do) working days and afternoons as the pain i suffer occurs mainly at night. I worked nights for 25 years. I think i can fill and send a form to the court varying the terms but have to do it asap, not sure what form? my husband lied all thru the process and i told the truth yet he was believed- mainly because his solicitor was really experienced and appeared to know every trick in the book which has made it more frightening for me. I hope you can make sense of this Celestine but i have to get ready for work. I will check back tonight when i get home. Thank you very much x
