    Hi all,
    I have also been an unlucky winner and received a letter from MET as attached along with an over view of the signs[IMG]file:///C:\Users\me\AppData\Local\Temp\msohtmlclip1\01\cli p_image001.png[/IMG], the "driver" visited on 5th Oct, PCN issued 11th Oct, received 16th Oct.
    For the "driver" parked in the car park (Park1) passing through the sign visited for stayed for 80 mins out of our 90min allotted time and then moved the car to a different car park (Park2) or so the driver thought.
    It turns out that this second car park is an extension of the 1st car park, on entering the other parking area (park 2) the "driver" did not pass or see another sign to indicate the "driver" was still in the MCD's car park.

    After receiving the PCN I revisited the car park, and the car park the "driver" had moved into to see if there were signs in it, the"driver" had originally parked in the first slot after the disabled bays with a large van next to the "driver" obscuring the sign.

    With the road and signage positioning does the "driver" in your opinion have a case to dispute poor signage and have grounds to dispute the PCN?
    The red cross on the MCD's image is the location of the signs and the right hand facing arrow is where the "driver" had parked after leaving the first car park.

    Any help and assistance is gratefully received

    Hi slothy, welcome to LB.

    It is best to start your very own thread.....multiple cases on one thread can lead to confusion.
    If you'd like our @Kati to do so, I'm sure the nice lady will do so.

    In the meantime, is there any chance you could get close-up pics of the current site signage? (Both locations).

        What was the reason for the driver's alleged overstay?
        If McD's was used, has anyone tried contacting the manager there to intercede?

          Unfortunatly the driver was having breakfast in McD's before signing up for his first universal credit interview which took another hour. the car was moved out of the McD's car park after he had finished..

          We will be visiting the manager tomorrow to see if they can do anything.

                    Have you contacted McD's yet?

                    Something that puzzles me here.
                    There do seem to be 2 separate car parks which share a common entrance/exit.
                    The signage which you've posted only limits the parking period to McD customers.
                    It doesn't say anything about the other (hotel?) car park.
                    If it were me I'd be looking more closely at that....are there 2 different contracts [parking co/McD's & parking co/hotel (or whatever)]?
                    Have a word with McD's & the hotel....see what gives.
                    There's a possible Consumer Rights Act defence here, but a bit more evidence would be handy.....any chance of some pics of the site not which is not on the McD side?

                    A tiny anomaly on the NtK.
                    They've got the driver entering & leaving, but not actually parking.
                    I know the site sign states 'maximum stay', but the legislation (PoFA 2012) specifically states that the NtK must show a period of parking.

                    I for one can think of few pleasures to equal the thrill of driving around McD car parks for 50 mins or so, whiling the time away & taking in the sights.
                    I'm joking, btw, but if there was some viable explanation for driving around, stop-start etc without actual being parked during the overstay, maybe someone could blag their way out of something like this.

                      hi @charitynjw, I spoke with the manager today.
                      he stated that if the driver had spoken with them when ordering and gave them the reg no they would have made a note of it onto the system so it would not have been timed.

                      I have found that you can make an appeal online on their website, whilst doing so I will point out that the close up photos they are showing are both white so could not possibly be one when arriving and one when leaving ( the rear number plate is yellow)

                      I called the store again to clarify if I need to apeal with MET, they will or both (it was a bit unclear). the manager this evening stated that she would contact MET and would email me back in a couple of days.
                      I also logged an apeal on the site to cover myself, just in case they forget.

                          Hi [MENTION=5553]charitynjw[/MENTION] having spoken with the store a few times now, they have said they will cancel the ticket.
                          It would apear that if you think you are going to be longer than the 90 mins and give your reg no. to them when ordering they will add you to the system which will stop you from being issued a ticket.
