I made a claim via MCOL against a client that didn't pay his final invoice. I did a lot of consultation work for the client, they paid all the interim invoices then emailed me to say they are cancelling the project, gave no reason, and then refused to pay the final invoice saying that they had never authorised the work. After proceedings started they "acknowledged" the claim but then no defence was received after that. I requested judgement by default and it was "issued".
11 days have passed. I've logged into MCOL and I now see the option to request a warrant. Should I be requesting it now? I read the MCOL booklet and it says that I can request a warrant if the money is not paid on time but doesn't say how long I have to wait. I requested to be paid immediately.
The company concerned has £350k cash, £1.5m assets, and £900k net worth and are still trading, so I'm not sure what they are playing at, in our industry potential clients do background checks so I would have thought the CCJ will cause them problems and I know they are constantly pitching for clients as we work in the same industry and people talk.
I don't really want to be contacting this client if I can avoid it, they were really unpleasant to me last time I spoke to them. I could ask my accountant to write to them but really prefer they just get communications from the court.
