  • Refund of payment

    My friend purchased a car paid some throughly card and some cash. The car was purchased 192 miles away and they have said they will refund but they will only pay the 200 through card and that she has to travel back to where she got the car from to get the rest of money because she paid it cash. She doesn't have transport not money left to be able to do this. Is there anything that can be done so that she can have the money refunded into her bank

    Presumably this is a refund following rejection of the car.
    CRA 2015 24 (16) stipulates "If the consumer paid money under the contract, the trader must give the refund using the same means of payment as the consumer used, unless the consumer expressly agrees otherwise"

    IMO that does not mean the trader can refuse to pay by any other means than cash in this instance. It means the consumer can refuse payment by any method other than cash.
    The trader needs an earful! And if he contines to refuse tell him to send it by signed for by Royal Mail Special Delivery Guaranteed.
    And if he refuses that he risks court claim!
