  • Capquest Investments and Drydens Solicitors

    Hiya , New to this but I would like some help.

    On the 3rd of may I had a county court claim form for a sum of 4,500 from drydens solicitors on behalf of capquest.

    On the 14th of may I defended the whole claim. Within a couple of days I had a letter saying they acknowledge receipt of my defence. A copy is being served to the claimant. They may contact me to resolve any dispute. If they can't they have 28 days after receiving my defence but if the period is elapsed the claim will be stayed.

    What should I do now??? Please help. I'm sick with worry!!

    Hi Jennifer_18, welcome to LB.

    Could you post up the particulars of claim?

    And also your submitted defence?

    Redact any personal identifiers.

    Have you any idea what the claim is for? (Eg credit card, overdraft etc.)

      Hiya thank you so much for replying. Yeah sure it was for a mail order/ very.co.uk.

      I was unaware of this debt. I checked my credit report it says September 2013. On my defence which probably isn't very good. I just wrote that I was unaware of this debt, no contacts with company regarding the debt and out of the blue a claim form which is unfair as I would of liked proof of this debt.

              That's just a summary on the claim I'm defending part from that I have no other documents or letters regarding this debt.

                Normally the particulars of claim say something like
                The defendant entered into an agreement with xxxxx on or about xxxx . The claim was assigned to the claimant on xxxx . The sum of xxxx is claimed.

                Do you have wording like that on the form, if so that is what [MENTION=5553]charitynjw[/MENTION] was asking

                The reason is that without these particulars it is difficult to offer advice.

                Also , apart from entering a defence, have you taken any other action?

                  Oh I see very sorry. No I never had anything like that in writing from them. Nothing that I entered into a an agreement. I only had a claim form saying capquest investments are asking over 4,500 and drydens are doing it on their behalf

                  I haven't taken any action. Should I write to the company asking for proof I owe the debt? xxx

                      Oh CL Finance, I was so close to getting one of them in 2012 after receiving a LBA. At the same time I sent off a S78 request , I did not understand the importance of that. never heard from then again, however it was only for £500

                              There is a link for the cca request

                              It is S77 for a loan and S78 for a credit card or catalogue account.

                              You say you have put a defence in is that correct?

                              What date was on the claim form because I think I would be looking at asking the solicitors if you could amend your defence although ai am not sure just how you do it.

                              You say you have never been in trouble before , this is not 'trouble' i.e the police can not get involved but could you clarify another point for me
