    Had a loan with welcome finance in 2007 but made no payment or acknowledge the debt cabot brought the account in 2014 and placed a ccj got this set aside as statue barred debt mortimer clarke are stating it not statue barres as welcome finace didnt terminate the agreement until 2012 5 years after any payment or acknowlegment of the debt i know this not to be true but wondering how i should defend this any advise

    You need to sar to Welcome finance. That should show you the history of the account. If at any time the account has been passed to a department listed as the local collections unit or loud then it will have been defaulted as all accounts were or shold have defaulted at that point. Also if the account had been passed over to launch then welcome would have decided it was unrecoverable and been written off prior to sale to an external agency.

      Ok thank you will get that requested now but surely even if they have surely they cant pit a default for 5 years after cause that would give companys nearly 11 years to collect on
