  • Employee enquiry - being fired for eating soup at desk...

Hi all. Not sure if this is the right forum or not...

I was quite ill. I have problems swallowing. For almost three months, I have been sick every morning. It is so bad, my teeth are actually rotting. Recently, I was so violently sick, I trapped a nerve in my neck. I am on about 20 pills each day to prevent pain, vomiting and choking.
After repeated calls from work, I went back in. Neck brace on, choking, being sick.
Work has a "no eating at desk policy" but as I didn't want to cause a scene in the canteen, I took my soup (In a sealed container supplied by the canteen) to my office (Locked office, nobody else in the area, etc.) I got an absurd email from the facilities manager, claiming I had endangered people by carrying "hot soup" down the corridor. I replied about my illness, giving symptoms, reasoning, etc., and how I wasn't prepared to humiliate myself in public by being sick in the canteen. I explained it was only soup and porridge, and that they were in sealed containers supplied by the canteen anyway.

Result: I have been suspended from my job, and am facing a disciplinary hearing on Monday.

Any help on my position would be appreciated...

To what extent was your employer aware that your symptoms were going to persist on your return to work?

If the condition that leads to the choking/vomiting has lasted, or is likely to last, at least 12 months it would qualify as a disability.
If that's the case; it could well be discrimination for them to subject you to any kind of detriment (e.g. disciplinary action) because of something associated with the disability.

I emailed them, explaining the issue, including what drug treatment I was on. They are well aware of ongoing issues. I've been having dental appointments since 2015 because the constant vomiting has rotted the enamel of my teeth for some time.

This is wrong. They could not fire you just for eating soup at desk. They must have made discrimination as a ground purpose to let you out from there.

This is really unethical. Your employer is not within their rights to fire your employee
