Gemini Parking PCN, failed appeal, advice please.

  • Gemini Parking PCN, failed appeal, advice please.

    HI hoping for some advice.

    the driver received a Parking Charge Notice issued by Gemini Parking solutions

    the driver parked in a Gyms car park, and never noticed any pay and display signs. when the driver returned they noticed a ticket

    The driver noticed another car displaying a scratch out date permit type card.

    the driver was not been informed about these cards, an email was sent to the gym about this for the fact that the car was ticketed the gym said to take it up with the parking company, but then informed that they can issue cards for a cost of £4.

    An appeal was made to gemini that has been rejected in forms of a standard letter stating signs were not seen, but the permit issue was not mentioned. Gemini has increased the fine to £100 and treating debt collecting which a will guess head down the court lines.

    I wonder what should the next step be, some have said to just ignore, but the driver does not want anything to affect their credit should it go to court and lose.

    i wonder what should be said in a letter to POPLA?

    [MENTION=5354]mystery1[/MENTION] once mentioned doing a 'self-help' popla appeal (but he's been massively busy) ... I'm sure you'll get lots of help from the Beagles before your popla is due.       Just a thought.
      The Beavis v PE case (Nov 2015) might make some of the older threads less applicable? [MENTION=5354]mystery1[/MENTION] & [MENTION=39331]ostell[/MENTION] might offer better info than me, though.

            Hi, you probably do need to appeal to POPLA, Gemini have started doing court (10 defended claims already this year), However POPLA is a bit of a minefield, they only take points of law into account. Any mitigating circumstances and they'll reject the appeal straight away. Can you hit them for grace period, poorly lit or hard to see signage? Did they supply any photos of the car?

                    Morning, im going to need to start doing my appeal for popla, just wondered if anyone has any advice on what to say in this letter.

                    not heard much back from the response that i posted in here so i really sure how to tackle this.

                        Hi, I've not actually done a POPLA appeal yet, all I know is they don't don't take any mitigating circumstances into account, only points of law, signage, times etc
