  • Hello - new car recall

    Hello, I'm trying to find out what my rights are in relation to a new car recall. I have received a letter from Vauxhall recalling my car ( purchased via personal contract plan on November 2015) due to a fault to the sunroof. Vauxhall have stated they will contact me again in May to arrange the car to be repaired. Due to the fault I have lost all confidence in the safety of the vehicle - I'm aware that i have 30 days to claim a refund but as my car was purchased more than 1 year ago what can I do? The fault was clearly there when the car was purchased so was faulty when Sold - can I ask for a refund?

        Hi and welcome to LB.

        As the fault has only become apparent after 30 days you have to allow the trader one attempt to repair the fault.

        If the fault is not corrected you could pursue a refund, but if successful a deduction would be made for usage .

        I really don't understand why a faulty sun roof should make you lose confidence in the safety of the vehicle, and your loss of confidence would not be a reason for rejecting the vehicle

          Unfortunately as the fault was after 30 days you have no automatic right to a refund. As we are now talking 12 months later and having admitted there is a fault your entitlement would be a repair or replacement of the vehicle. Since its a product recall, Vauxhall have a duty to tell you what the problem is with the sunroof - have they explained this to you?

          Can I ask how the sunroof makes you lose all confidence in the safety of the vehicle, particularly as you've been driving it for 12 months (assuming without issue as you have not mentioned any prior issues)? You could write to Vauxhall for a refund but is unlikely they will offer one nor are they obliged to give you one - perhaps compensation for the safety issue.

            Thank you for your response. My lack of confidence is actually with Vauxhall due to the numerous recalls that have occurred over the last few years ( shocked me when I researched it, and also the recent zafira problems). The letter from Vauxhall pointed out that there was a risk of the sunroof blowing off due to the defective glue used at manufacture......which of course I had not been aware of - probably overreacting but can't help wondering what else may be defective! Thank you again for taking the time to respond. Hopefully I will hear from Vauxhall soon in order to get the defect rectified!
