ccj claim from Lowell solicitors but I do not know what the debt is for, help please

  • ccj claim from Lowell solicitors but I do not know what the debt is for, help please

    Hi I have just received a claim form from Lowell portfolio ltd but I do not understand what this debt is for. The claim states that the original debt was from Orange for 198 pounds. However I did have a debt will orange but this was for like 300 odd pounds and I paid this debt off via another debt company. I cannot remember who as it was so long ago. I vaguely remember the debt company when i had cleared the debt sending me a letter that stated the debt was paid but that I had to take out a further contract with orange or pay a further amount ( cant remember what) If memory serves me correctly i did speak to someone on the phone as i did not understand and still did not after the phone call. I think they told me to basically pay orange contract every month or pay more. I never signed anything agreeing to this. It was so long ago I cannot remember the exact information. Anyway back to know the claim form tells me that the agreement what ever this agreement was allocated to them 23/12/2014. I have been online to the money claim sight to do the acknowledgement of service and stated i intent to defend all of the claim. I just do not know what i need to do. Is there a way of requesting a copy of this agreement they claim i made from the claimant? If so how, also how do I defend my claim. I am sure I made my repayments of original debt via dd every month so should be able to provide this to the court if it comes to that. any help would be appreciated

    How long ago did these Orange shenanigans take place?

    When was it you last paid them? Is there any hope that this debt may be Statute Barred if this took place over six years ago?

    You need to find out what went on over the phone about the new/replacement contract. Did you receive a SIM card as a result or did you already have a SIM and a handset so you may have been re-contracting/upgrading etc?

    You've filed your Acknowledgment of Service so now you need to send a CPR 31.14 Request to Lowells Solicitors. This forum has a template letter for that here > http://legalbeagles.info/forums/show...382#post410382

      Thanks Diana M. I did not receive a new sim or handset after the phone call. I remember speaking to orange telling them what the debt agency had told me and they did not have a clue. so I never perused it. I am just sifting through my bank statements to try and find the direct debit i used to pay for the original debt. I have used the template but have got a bit confused by the red bits. On my particulars of claim it only talks about an agreement so do I only request a copy of the agreement. Also the last red bit down the bottom do I need to include that if so who do i send the 1 pound to x

        Just tried searching my bank statem,ent so they only go back 2014. Will i need to access my credit file to find out?

          sorry for the constant posting. I found the original orange account on my noodle account that is showing as settled on 4/04/2013 and is closed. The lowell one is on the open list for an amount of 198 pounds. it says account start date 2011 default date 29/03/2013.

            sent a CPR 31.14 26 april to lowell but still no response, what do i do now

            Hi after posting a couple of weeks ago (26 April) seeking advice about a claim form i received about a debt i do not believe is mine. I sent a request CPR 31.14 to Lowell solicitors. But i have still not received an response. I did my acknowledgement of service online on 26th so not sure how long i have to file a defence is it 28 days?. what do i do next as i have received no response atall.
            please help

                      No worries.

                      You have acknowledged the claim, so your defence is due 33 days (28 + 5 to allow for post) from the claim issue date. (Which was....?).
                      It is not unusual for them to fail to respond to a CPR 31 request.
                      But you can use that failure as part of your defence.
                      Did you get proof of posting?

                        my claim form says 24 April. I received it on 26th April and did the acknowledgement that day. yest i sent recorded delivery. I am not sure how to do the defence bit and when do i start it is it when the 33 days are up or before please?

                            The gist was
                            Defence due 27th May, which I believe is a Saturday, so at a pinch, Mon 29th (but check date(s) yourself)

                            Will give you an idea of the layout, but you'll need to tweak the content, as the Consumer Credit Act is not normally applicable to mobile 'phone cases.
