    Default Lowell debt recovery

My daughter is just looking in to getting a mortgage, she paid off an account with Littlewoods and didnt think anything about it, about a year later she noticed on her credit file that littlewoods had put a default on her credit reference file, she contacted them, they told her that interest was due the following month and was outstanding, she didnt get any letters, she agreed to pay what was outstanding now £108 as she didnt want adverse credit report, Littlewoods agreed to remove the default, she said that she did not accept the debt as she didnt agree with it and she had borrowed money from family but she wanted her file clear. Littlewoods did remove the default. She has now discovered that Lowell have put a default on her credit file 10 months later as they bought the debt, how can they buy a debt that had been paid off?? does anyone know how she now tackles Lowell??? would really appreciate some help

She needs to write to Lowell and say that (a) the debt has been settled on dd/mm/yy with Littlewoods so it should never have been sold to Lowells and (b) Littlewoods agreed to remove the default date so Lowells should too.

Address any letters to Andrew Bartle COO of Lowell and mark it confidential to avoid customer (dis) service mob.

thank you so much for your replies, it seems that writing is the way to deal with it, its all very strange because Lowell have recorded a default for a 0 balance on experian but on equifax they have recorded settled and no default! they shouldn't have been sold it in the first place Lowell were not helpful

The " settled " entry happens when the original creditor is paid by the debt purchaser.

It's always advisable to deal with the likes of Lowell in writing!!

Since you say that your daughter settled the matter with Littlewoods less than a year ago it may make sense for her to ask them for written confirmation of the final arrangement (including the CRA default removal).

She could make a formal complaint to Littlewoods that they shouldn't have sold a 'debt' which didn't exist. This may result in them recalling the account from Lowells.

It's wise (and essential) to make Lowells aware of the situation so things don't escalate but they will need evidence before they'll take action. Obviously they have a duty to check the status of the debt they purchased with the original creditor once you bring it to their attention, but it may speed things up if she can provide them with some evidence when she writes to them.

Lowells have a formal complaints procedure so the letter should go there. The Chief Operating Officer will only refer it to that department which could delay things. Here are the details > https://www.lowell.co.uk/media/1068/...re-leaflet.pdf

She could also add a Notice of Correction on her CRA files. Here's some information on how to do that from Experian's website >

    http://www.experian.co.uk/consumer/faq/AR5.html

A NOC flags up to anyone searching her file so if she is in a hurry to make that mortgage application then it should help, although I think she's better off waiting until her file is squeaky clean.

Thank you Di, thankfully the house she is looking at isn't being released until August so she has a bit of time, we will get onto this straight away, really appreciate your time

Hi that would make sense to me but it is Lowell that have recorded the account settled, not Littlewoods??
