Well that may give them a headache since they may have to produce two credit agreements if you opened two separate loans.

    We'll see.

    No problem

As I said I only know because I had a few of these loans and more by luck than judgement I still had one when I sent a CCA request off.

Lowell had amalgamated 3 loans into one , they managed to send me the front three pages of all 3 but were unable to send the terms and conditions. To be honest they were hard enough to read on the original let alone if they had photocopied them

If they only send the fronts you should be OK

I know why they litigate these-because most people don't fight them - but I am hoping for the best for you

As you say it is 5 K- worth looking into trying to get some legal advice if it looks like it might go all the way

the forum will do all it can for you but as has been said on many occasion , the devil is in the detail.
@Diana M The interest rate on standard provident loans was about a flat 58%ish I think . £3 a week for 53 weeks on every £100 borrowed

On their website today they're quoting the following example >

Representative example: £270 loan over 26 weeks. 26 payments of £16.20 per week. Rate of interest 112% p.a. fixed.
    Representative 535.3% APR.
    Total amount payable £421.20.

    They then say comfortingly >

Loans can be repaid over a period of 13 to 52 weeks depending on the loan term chosen at application. The maximum APR for a loan is 1557.7%.

They lull the unsuspecting and desparate by saying Its only 3 a week per week. It seems ok.

The claimant has 12 + 2 Working Days from the date they receive the request to comply after which the debt is rendered unenforceable until the agreement or a compliant reconstituted one is provided.

You have one more task to do before you can sit back and wait for things to happen

I'm not sure that there is a SAR template in the Green Box. I can't find it there. Do you have a link in case I've missed it?

I would raise a complaint with Royal mail giving them a tracking number and say there is no proof of delivery

They have always come back to me with an email saying it was delivered - even if there is no signature it would add to the weight of evidence if it were ever needed.

Thanks guys. Do i just go into the p.o then and do that as checked again this morning and it's still saying the same thing. I'm getting worried now. Also had a letter from Lowell solicitor yesterday to say they are getting into contact with their client to get the paperwork they need and my account is on hold until then. But I'm just so worried about the cca request.

    Hi flicky

Your defence is not due yet....I see the date has been thrashed out on previous posts.....so no need to panic.
If you used the forum template CPR 31.14 letter, within same is an invitation to the Claimants for a 28 day extension to the current due 'defence date'. If they agree to the extension, you (the Defendant) will need to inform the court of this.
But either way, the Claimant's 'account on hold' means nothing in the court proceedings.
    Stick to the court timetable.
If you are really concerned about the CCA request not being delivered, you could resend it (+ another £1 fee) via ordinary first class post. Proof of posting is usually counted as proof of delivery within 2 days, & you can get a free certificate of posting to evidence the fact.
