    Default Eviction due to social service taking kids

    Hey,I am in a bit of a down situation right now!

    on the 9th March social service placed my kids into foster care! I am working hard to get them back but can't apply for another children's hearing till 9th June!

    Yesterday I had a message from my landlord stating that I might get evicted due to me not being entitled to housing benefit!

    I am currently in a private let 3bedrooms!

    I've moved to Scotland 3years ago from Germany and don't have a clue about all this! I am worried that if I get evicted I won't have any chance to get my girls back!

    Hi and welcome to LB, sorry about your situation and I am not the one to give you definite advice so I will flag someone who can hopefully even though you are in Scotland and things may be a tad different.
    Have a read of this from SHELTER it may answer some of your worries for no.

    Hi

    Not sure about scotland, and it depends on the orders specific wording, but you can usualy apply for extended payments for up to six months whilst your fighting to get them back

    Do you have a solsitor, if not get one asap. Social workers do lots of good work, but occasionaly over react or make mistakes, in these curcumstances you deffinatly need legal help

    And of course they're shut today and Monday..there are open on Tuesday and no appointment will be needed.

    You're a long way off getting evicted. Your Landlord would normally have to seek possession through the courts before that can happen.

    What kind of tenancy are you on? Is it Assured, Short Assured or Regulated?

    Do you currently have any rent arrears?

    Do you have legal help in your battle to get your girls back and, if so, could that lawyer help you with your housing situation such as a letter to your local authority to suggest this may be only a temporary situation?

    Are your kids allowed to see you or come and stay with you while they are being fostered so you could argue you still need their bedrooms?

    How old are the girls?

    It's a short assured tenancy moved in last year October and I am behind with the rent for 1 month cause I had to go from income support to jsa!I've got supervised contact 3 times a week for 2hours but not at home yet but obviously working towards getting rhenium back!9th June is the next time I can apply for another children's hearing to gethe my girls back!my girls are 9,8 and 6years old!I've got a good solicitor who is helping me as much as she can I will speak to her and see what she says!

    As others have said, Kathrin, contact shelter but also contact your local Citizens' Advice Bureau!
