• Received Claim Form - County Court Business Centre

Hi All,

My mother in law received the attached letter from the County Court Business Centre, If I recall rightly it was from a parking fine when she parked in Asda's free car park and over stayed by about 10 mins and was slapped with an £85 fine, which in itself typical of private parking firms.

I really don't know what to advise her, and would really like some help and advice.

I don't really want her to go to court, but she also doesn't have that kind of money to pay such a hefty fine.

Any advice much appreciated :-)

Hi sjs2000 ... firstly, your mother needs to acknowledge receipt of the claim with an intent to defend in full (no defence needed yet tho'). See here for details (post #2) http://legalbeagles.info/forums/show...313#post499313

I'll tag mystery1 for you (he's our parking charge guru ) xx

Once you get the particulars of claim, post them up here. If you get to 21st without them let us know.

Have you got the PCN or pictures of the signs ?

Have you spoken to the Asda management ?

Thank you so much for your help on this. She lives in Birmingham so had to wait for her to send it all to me. After looking at this..the said carpark is my partners old gym where you get two hours free parking, we've emailed the gym for confirmation of membership. This means that she wasn't even driving, what should we do?

Do you have (or can get) pictures of the signs, the PCN, confirmation of signing in at the gym ?

File acknowledgement of service for now.

Can you post the 2/3 pages of the particulars of claim that you haven't done yet ? (I hid the other stuff as you left her name on them)

Hello, me again, the gym has confirmed my partner's attendance during the time at which he ticket was issued for. What is my next step should we fill out the dispute form? they send so much paper work at you it's scary.
Please find below your attendance for the date you have requested:

You are allowed two hours at the gym free parking, the gym don't have access to the registration machine, but I'm sure the parking people do, so would see that we normally log our registration plate in every time.

Thank you, do i just fill in and send to the court along with the other papers? Sorry for sounding daft but assuming, susan (mother in law) is admitting she is the registered keeper, but are we saying that she wasn't driving? Her son was using the gym? Should we say that?

We say that. I'd rather say a family member but if push came to shove.

Try and see if you can do it online but if not email would be best as the deadline is near.

Sorry me again, do I include this information on the defence and counter claim form within the 3. Defence section? Thank you.

You don't really have time to do that. Try submitting it online as it's quicker.
