    Hi,

    Can someone please help me. I have received a Letter from DRP on behalf of Excel with the heading Letter before referral for legal action for a parking fine dating back to 2013.

    I first received a letter about the fine back in July 2016, which was the first I'd heard about it, the letter was also addressed to my first & middle name not my surname.

    My parents still live at the address it was sent to, so a naturally worried someone is going to come knocking on the door.

    I contacted DRP, at first they refused to speak to me as I gave them my correct surname, finally when I gave them my middle name they spoke to me.

    they told me they had been chasing me for payment, which I said isn't correct as I was still living that this address till late 2014. I asked about an appeals process, and was told it is long gone.

    In the end I has them to investigate, I wanted photographic evidence and times of when I was apparently there. I gave them my contact number, email address. DRP said they would get back to me.

    Move to March 2017 - my parents have received another letter for pending legal action!! Call them yet again and apparently I spoke to the same guy I did in July 2016. He asked me make to payment to which I refused as evidence as requested hadn't been supplied.

    He said it isn't normal practise for them to take this long and would be back to me within 48hr. That was a week ago? do I call them again?

    So you ignore DRP. They are merely debt collectors and if it does go to court then they will not be paid.

    Do not phone these people and make sure they do not know who was driving.

      Hi,

      I have just received a text message from DRP asking me to contact them - the first time they have done so, I assumed it was regarding the evidence I have requested. They basically wanted me to pay.

      The guy on the other end of the phone was quite stern and wad like are you paying or not, then said are you categorically telling me on a recorded call that you aren't paying to which is said I am happy to pay as long as I had evidence. He also told me to contact the DVLA and find out if they provided the information, tho which I have to be told it is going to be 2-4 weeks maybe.

      I'm tempted to pay it,

      they have told me Excel don't actually need to provide the evidence, only if it goes to court.

      I don't know what to do for the best - he actually told me to consult a solicitor. Surely it cant go to court if I have repeatedly asked for evidence to which they aren't providing it??

      I also said if the evidence is provided, given I only heard about this last year I would be happy to pay the original fine to which they said no that wouldn't be accepted!

          Do I send them an email with regards to the conversation which took place and ask for evidence again?

            Personally, I'd be tempted to ignore anything except a court claim now (you've requested documents/proof and they have not been forthcoming). M1 might have other ideas, so hang tight until he replies

                DRP only want money. Ever.

                If you get a letter before action or court papers come back for help. Keep the drivers identity to yourself.

                  The letter I have received now is Letter before referral of Legal Action.

                  I am assuming this would the next letter? They did say they would ask for evidence again but I'm assuming they wont.

                  What would be the next step should I receive a letter before action?

                  I don't quite understand why they have waited nearly a year to send another letter?

                    Maybe yes, maybe no.

                    What would be the next step should I receive a letter before action?
                    Write to them and ask for information. It may seem repetitive but it looks good for court if you're seen to be engaging with them and if they supply information it helps construct a defence, if one is available.

                    I don't quite understand why they have waited nearly a year to send another letter?
                    They can only chase so many at a time. Probably got many many 1000's to pick from.

                          To whom it may concern,

                          I am writing to you with regards to the case reference aboveRE: Parked without displaying a valid ticket-permit.

                          The charge in question is dated 1st February2014. The first piece of correspondence received for this was 7thJuly 2016.

                          The letter in question was sent to my parents’ house towhich I moved out in 2014. Upon receiving this letter, I called DRP at whichyou refused to speak to me when I gave you my name as the letter you issued andapparently the information you received from Excel was in the name xxxxxxx. Thisis my middle name.

                          I spoke to a gentleman which I now believe to be calledMike, as when I called again regarding this matter he told me I had spoken tohim previously.

                          I explained the situation to Mike that this was the firstpiece of correspondence and that I didn’t have a clue about the ‘fine’ and thatI had indeed moved out in 2014 nor has myself or my parent received anyletters.

                          He asked me to pay to fine, to which I asked for evidenceof parking without a valid ticket i.e. pictures, time scale the driver was apparentlyin the vicinity to which he said he would contact Excel and get back to me. Whenasked about an appeals process they said it had been and gone.

                          At this point I gave all my current details where to contact me as I didn’t wantadded stress on my parents.

                          We heard nothing until my parents received another letterlate last month (March 2017) advising ‘Letter before referral for legal action’

                          I then called DRP again Monday (27th March)and spoke to Mike, he told me it’s strange no evidence has been provided andthat it has taken nearly 12 months to send out another letter, but again hewould go back to Excel and request this information again. And that it shouldtake around 48 hours to a week.

                          Today (5th April 2017) I received a textmessage from DRP instructing me to call ASAP regarding this case.

                          I spoke to Lee who was quite straight to the point andasked if I was paying this fine. When I replied no, he said so you are categoricallynot paying this fine, to which I said that’s not what I am saying , we are waitingon evidence being provided, and if the evidence shows in favor of Excel thedriver would pay, however the driver would only want to pay £60 as no chance wasever given to appeal or pay the initial fine as no correspondence was received until2016

                          To which Lee replied no chance, that wouldn’t beaccepted.

                          Lee also informed me Excel do not need to provideevidence until they take me to court, and in turn contact the DVLA to find outwho has requested information .

                          As they received instructionsin 2016 to chase payment therefore someone else beforehand should have beenchasing.

                          I have since contacted the DVLA and this all needs to bedo via post and can take anything up to 4 weeks.

                          I would like to stress at this point, payment has onlybeen withheld due to the lack of evidence being given upon request.

                          To expect any member of the public to remember what theywere doing more than 3 years is ludicrous.
