    Hi guys

    I have just VT my finance agreement for my BMW, the collection guy and inspection guy both came while I was working but my mum was in to give him the keys he then wrote on the report after half an hour inspecting it there was no spare key which I wasn't given one to start with and a £70 scratch mark totalling £220 they gave my mum the paperwork and made her sign it can they do that if it's not even my signature? and I wasn't givin a key to start with. Any ideas

    Firstly, they can't 'make' your mum sign anything. If you didn't want her to sign it you should have instructed her not to sign any documents, nevertheless if you weren't given a spare key when you first took hold of the car they can't charge you for something you never had. the onus is on BMW to prove that you were given a spare at the time of taking possession.

    As for the scratch, it's subjective and you have to determine how bad it is. If it is a deep scratch that was caused by you when you had the car, then it is possible you owe it but if it is minor then you could argue that it is reasonable wear and tear.

    Are they charging you £180 for not having a spare key?

      Hi thanks

      well we knew they were coming but shouldn't it of been me to sign the document as it's my car to be legal. It was Arnold Clark that gave me it without the spare they were meant to send it out but nothing ever came to it, and there saying they don't have any orders for it bearing in mind this was 3 years ago when I first got my car.

      I didnt even notice the scratch I tried to tidy the car up as much as possible but stone chips from motorway driving can't be helped.

      yes well £150 for a spare key
