        There were no contact details of the claimants solicitors on the claim form from the court. It was signed by the claimants legal representative therefore I sent the request letters direct to PRA Group.

        Am I ok to continue sending the defence?

          If you sent the CPR 31.14 to the address given on the court claim form, I reckon you're good to go with your defence.

              Usually, the court notifies you that your defence has been accepted, that a copy has been sent to the Claimant & that they (Claimant) have 28 days to reply to it.

                Ok. I will let you know if I receive any further correspondence. I must admit though I'm a little worried I've missed the deadline!!!

                  Call the court to check they've received it or login online and see it for yourself. Don't panic if it's not showing since the database can be a couple of days behind updating.

                  Although the Defence deadline was 4 pm yesterday the MCOL system won't allow the Claimant to enter a request for judgment until after midnight.

                        I also suggested that you should send a Subject Access Request to MBNA.

                          Hi Di. I haven't sent a subject access request to MBNA but I will do so.

                          Just to give you a further update, I received a letter from the Court where they have acknowledged my defence, and yesterday I received a letter from PRA Group where they have confirmed that they are continuing with their claim.

                          Other than sending a subject access request to MBNA do I need to do anything else in the meantime?

                            Hi Di,

                            I did send a CCA request and a CPR 31.14 request to PRA Group. I received a letter from them acknowledging receipt and that they would supply me with the information however I have not received anything from them. Do I still need to send a Subject Access Request to MBNA and if so can you supply me with a Template letter?

                                You really must send that SAR asap. I've been nagging you to do this since February. The contents could be the make or break evidence you need to help you defeat this claim.

                                The POC have a two year 'information gap'. By that I mean where did the account go after it was defaulted by MBNA in 2009 and when it popped up again at AK in 2012?

                                I think it may have been assigned to Varde/Experto Credite during that period but I can't help you if you don't get the facts from your MBNA SAR.

                                What I can say it that I'd be surprised if PRA don't take this claim all the way to a Trial so you need to focus.
