    Hi LB

    Just wondering if I should respond to the below? These guys have been emailing me for probably 2 years which I've ignored so far. I think it refers to a couple of payday loans I've apparently not paid from 4 or 5 years ago - I've no idea though.

    Usually prove it letter / email and go from there? What's anyone's experience with these companies?

    Have you at any point had a letter through the post as opposed to email?

    I suspect you are aware just when these loans were taken out or last paid but understand that you may not want to post anything that could be classed as confirmation.

    Did you ever receive any notice of assignments?

    The problem I can see in replying is that they will know you have received the emails although I suspect that they know that anyway- there is plenty of software out there that will tell you if an email has been received.

    I had some dealings with MMF and made a thorough nuisance of myself, the account was then sent back to the original lender

    Id the accounts are relatively recent there is an argument, maybe, for misselling although that means acknowledging the accout

      Personally, I'd be ignoring any emails (setting my account so they all go into my junk folder) and waiting for a proper letter ... [MENTION=98117]warwick65[/MENTION] has already tagged DC, so you've got the best advice coming possible xx

        First it's a good idea to look at your credit records to see if you can work out what the original debt was. Use Noddle to look at Call Credit and MSE's Credit Club to check Experian. (I don't know of any payday lender that only used Equifax, so you can probably skip that one.)

        If this is a payday loan debt from 4-5 years ago then it's not going to be statute barred. If they start a court case you can obviously ask them to produce CCA information - but this is normally pretty easy for payday loans, so the chance of this helping is small

        MMF has a bad reputaion for inaccurate systems, chasing people for payday loans that have been repaid or where the balance is wrong. See https://debtcamel.co.uk/mmf-debt-write-off/. If you get in contact with them, you need to ask for a Statement of Account and check it in detail against your bank statements and any emails you have from the lender.

        They also have a bad reputaion for adding innaccurate default dates to credit records. And for being very aggressive, including court action. It sounds as though they know you are the debtor and where you live. The chance of them giving up on this if you ignore them is not good.

        If you borrowed from a payday lender you may have an affordability complaint, see https://debtcamel.co.uk/payday-loan-refunds/. This includes loans that you repaid on time, not just ones you defaulted on. It's not just for recent loans: it still applies to loans over 6 years old, but these will take longer to resolve.

        Your dilemma is that if you put in an affordability complaint you are acknowledging the debt, so there is no hope of the MMF just giving up. It also resets the statute barred clok but if your 4-5 years is right, that doesn't matter as you aren't close to the debt being statute barred.

        If you wait until you receive a court form, you can start an affordability complaint then but it is going to be much more complex to get the court action stayed, see https://debtcamel.co.uk/court-payday-loan-debt/. If a Claim form arrives, that is what you have to do. But it is massively simpler to start a complaint before a Claim Form arrives - you complain to the original lender and inform MMF that you are disputing the debt and ask them to put a halt to any enforcement action until your complaint is resolved.

        Once there is a CCJ, you can't put in an affordability complaint.

        If you succeed with an affordability complaint, any interest and charges will removed from your outstanding balance. And any redress from loans you repaid will be used to reduce the balance further.

        You should be considering affordability complaints against ANY payday lenders you used, not just for these loans that ended up with MMF.

        Which lenders did you use? If you used Swift Sterling or Pounds Till Payday these were Maltese lenders and the reclaim process is longer and less likely to produce a good result, BUT if you don't get a good result, this could be good grounds for defence in court.
