  • JBW enforcement notice for "Road Traffic"

    Hello.

    Woke up this morning to a piece of paper stuffed through the door from a company called JBW claiming an enforcement notice (in nice big bright red letters) for debt type: "Road Traffic" - whatever that means. The name on the paper is that of my SO. As far as we are aware, this is the first letter they have sent her (although she says she has thrown out some letters before she thought were from student finance, but may have been from this company)

    The letter claims balance due is £423, however there is no mention of what this is for (except Debt Type: Road traffic) SO says she has had penalty notices on her car before, but as far as she is aware these were all paid. There is no breakdown of costs, the address simply has our house number followed by the city name - no street name. There are also 4 boxes where they say they will come back, one evening, morning, weekend or today. None of these are ticked.

    It says the enforcement agents name, but only gives his first name and a mobile number. I have made no attempt to contact him. The piece of paper doesn't look like any legal example of an enforcement notice I have managed to find online. There are no references to any sort of fines, just that we owe the balance of £423. I can upload pictures if needed.

    This was presumably delivered by hand before 8AM, was not in an envelope. From what I have researched online, I should not let them in if they do come back, they have no legal power to enter my house.

    What would be my best course of action? Should we get in touch with the agent or the company and try to find out exactly what this charge is for? Road traffic suggests to me an unpaid traffic fine. Is this something we definitely have to pay, and can this guy enter my house if I leave a door unlocked? Very confused and slightly scared, any advice would be greatly appreciated. We can probably afford to pay off the full amount if that's what we have to do, it might just mean eating noodles for a month.

    Have also just noticed they have stuck an warning of immobilisation on her motorbike that is parked outside, but have not put a clamp on it. This was done at 7am today.

      This is what i would do;
      Text and ask for a full explanation including a breakdown of the sum so you can see the fine, fee's and costs.
      Do not open the door if you are threatened with locksmiths tell them you have internal bolts that a lock smith cannot undo. they are playing an intimidation game do not pay a penny untilll you are sure you have to.

        Don't think JBW can collect Magistrates fines, so could be council PCN, she needs to ask JBW what they are for, and move the motorcycle off the road to somewhere secure, they may try to sieze it if it is on the street unusual that they haven't clamped it

          This will be for an unpaid parking ticket, driving in a bus lane or similar. You are going to need to find out what Council, what offence & the ticket number. Then you will need to decide whether you can mount an appeal against it although if you think they have been ignored you may find this difficult.

          Probably not worth taking as they will need to realise quite a faie bit if sold.

            Should have mentioned, bike was off the road on a ramp leading down to the house. We can move it, but where do we stand legally on it? It's not immobilised, and there is no clamp or device to stop us moving it. There is nothing on the notice saying we can't move it

            Also from what I have read on citizens advice, they can't take any action for 7 days after an enforcement notice is issued? The example on there is also nothing like the enforcement notice they put through the door.

              What you must do is to contact the local authority who issued the ticket. Ask them what address all notices had been sent to and the what vehicle registration number this contravention relates to.

              If the documents had been sent to a previous address, then an Out of Time witness statement could be considered.

              The notice that you have received is unfortunately NOT a Notice of Enforcement. Instead, it is a hand delivered notice advising of a personal visit. The purpose of the visit is to 'take control of goods'. Accordingly, the debt has now spiralled to include the visit fee of £235.

              Before getting to this very last stage, the following notices would have been sent:

              Notice to Owner from the council

              Charge Certificate from the council

              Order for Recover from the council

              Notice of Enforcement from JBW Judicial Services.

              Please post back once you have spoken with the council.
