    Last week 2 High court officers arrived at my friends partners house with a warrant to recover the sum of £1900 with a channel 5 filming crew ! Apparently she has a unpaid parking fine dating from Feb 2016 she has never received any noticafication regarding this as she no longer resides at the address and hasn't since Jan 2016, she had kept in touch with the person she shared the flat with and any letters was forwarded to her, but on this matter she definitely received no letter regarding the parking fine, the long and short of it is they have repossessed her car and they Baliffs have informed her the car will be auction to recover the dept which now stands at £3000 pound, the warrant they had was for a address she had previously lived at ! To say my friend is frantic is a under statement, she has written to the companies involved asking to explain how this has happen and also she now has a CCJ against her.......what is so unbelievable is how can £1.00 parking ticket esclalate to this amount of money ?

    The car has not been repossessed but sounds as if it has been seized & removed. Is the car on any finance & what sort of value would she put on it? She may need to make an emergency application for a Stay of Execution against the Writ they have which hopefully should then give her a little breathing space to sort the rest out.

      Thank you for the reply, No she has no finance actually on the car , a (bank loan) and the car is a 2011 plate and in really good clean condition so if it had to auction she thinks it would clear the £3000 ! I've just asked if she has applied for as you suggest, she hasn't as it could involve more fees ! She has made a complaint to FCA !

        That is probably why they took it.

        She needs to make an application for a Stay Of Execution against the Writ that DCBL hold. This is made on Form N244 - from HMCTS website. Once completed the Form is better taken in person to a County Court that also acts as District Registry of the High Court, she must explain the urgency of the application - that DCBL are preparing to sell her car at auction for a CCJ she knows nothing about. If granted this prevents them doing anything else with the vehicle pending a further Hearing. Cost of the application is £255 but if on certain Benefits or low wage the fee could be waived in full or in part - Forms EX160a & EX160c refer.

            It is urgent she deals with this ASAP -preferably tomorrow as car could be sold .
