  • Unfinished Double Yellow Lines

    There are a few roads in my area which have intermittent double yellow lines.
    They look as though cars were parked there when the road markers came so they just painted in between.

    They have been this way for some time (over a month in one case) and tickets have been given out to people parked there even though they are not on the lines.
    There are no signs stating 'no parking'.

    The council refuse to squash the fines, stating "there should be lines there".

    Is this legal?

    Many cars have been ticketed, there is always cars parked there as it is handy free parking for town.
    It seems a good little earner at the moment but do the fines legally have to be paid?

    The gap in the lines get-out disappeared a long time ago.

    Though if gaps a large enough that that a motorist may miss the DYL then maybe have a valid claim.

      One of the gaps is big enough for three cars!
      I wish I could post photos of the roads.

      A friend of mine got a ticket last week where they'd done the same thing. She had seen them paint the lines and they left a large gap ~ there was no car parked there. She asked if it was a parking space and was told it is so has been parking there for five weeks with no problem. Last week she was given a ticket. When she went to argue her case she was told that there should have been double yellow lines there.

      How can someone be given a ticket when the space was deliberately left? She is someone who never parks where she shouldn't, shes not looking for a way out of something she shouldn't have done, she genuinely believed she could.

      To leave these gaps for so many weeks seems more like a deliberate trap.

            No. There's nothing there at all apart from intermittent lines. It was line free before.

              Adjudicators usually rule that faint or intermittent DYL's are enforceable if they are 'substantially compliant' ie it's fairly obvious that there is a restriction. However those cases usually involve old lines not newly painted ones.

              The councils stance that they should be there is ridiculous, if so why aren't they there. You would need to take it all the way to adjudication, but would almost certainly win.

                Aylesbury Road in Bournemouth. There was never any lines there before.

                The road my friend received a ticket on is Browning Road. There had been very faded lines there and were being repainted. She saw the guys painting and leave a large gap ~ there were no cars there ~ so she asked if it was now a parking space and was told that it is. She has parked there ever since (five weeks) In this gap the old yellow lines are now so faded they cannot be seen.
                Before the repainting she didn't park there because although the lines were so faded she knew they were there (if you see what I mean).

                It seems crazy to pay workers to only partially repaint lines. If they are meant to be there why not put them there?

                    Only Browning Rd i can find is n Poole or a Browning Ave in Bournemouth, neither of which show DYL's on Google Streets.

                      No ticket from Aylesbury Road but unsure if I can park there. I did but was told I was lucky not to get a ticket.
                      Sorry its Browning Avenue. It had very old, faded DYL and has now been redone apart from this space. The council say "it should be DYL" so tickets are being upheld.

                      My friend refuses to pay and will go to court over it but we wondered where she stands. She can't prove there was no car there when they left the gap and also can't prove she was told by the painters it is a parking space.

                      It seems like a deliberate trap.

                        Michael looking at that it appears the lines are meant to be intermittent?

                          The Blue car is in Browning Avenue, which used to have very faded double yellow lines then was repainted five weeks ago deliberately leaving the gap where my friend received a ticket last week.
                          The others are Aylesbury Road and been like that for a week. The largest gap can fit three small cars.

                              I'd like to see the exact wording of the council's rejection. "it should be DYL" implies they accept that they know lines are missing,but aren't prepared to do anything about it.

                              Assuming she has only made informal challenge which has been rejected, she has the choice of paying the reduced penalty or waiting for the Notice to Owner (when full penalty is due) and making formal representations, which if rejected can then be appealed (at no additional cost) to the adjudicator.

                              TBH both are irrelevant. What is relevant is they re-newed the DYL's leaving large gaps along the road. They have a duty with signs and road markings to clearly convey restrictions to a motorist. There may or may not have been cars parked at the time which meant they couldn't line the entire road. However they haven't lined the gaps in months and it's not for the motorist to guess what restrictions are in place, they have to be clear.
