What can bailiffs take?

Hello
Please can someone tell me if a bailiff/EA can take a car from a driveway if the registered keeper is in prison over unpaid ParkingEye tickets for the same car.

No idea. However, if this is connected to the parking eye court claim, then no they can't because they need a judgement first of all.

If it is as M1 says above then providing the claim will be for under £600 then it would be the County Court Bailiff that would attend. Yes the vehicle could be taken. To prevent this then the vehicle should be locked in a garage, parked on private land - unless of course their normal address is elsewhere in which case your drive would be classed as private or they need to transfer ownership before a Warrant of Control is sought.

If I transfer ownership today can the car still be left on the drive at the RK address?

If you change the V5 you will be the registered keeper

For enforcement purposes a Bailiff may only seize the goods of the debtor. Where vehicles are concerned the V5 only gives the registered keeper who may not necessarily be the legal owner. For local authority parking tickets etc it is the RK who is responsible for any tickets issued but again if it gets to Bailiff stage they may only seize the car if the person named on the Warrant owns it. However it is usually sufficient for them to be of the belief that the RK owns the vehicle particularly if the insurance is also in their name. Confusing a bit I agree.

If you become the RK then this puts an extra name on the V5 for the amount of times the vehicle has changed hands. On the day you take possession you must also tax & insure the vehicle, or if it is SORN complete a new declaration.

It's parking eye not local authority

If it were local authority the RK would have been made aware of any tickets issued and would have willingly paid the parking charge within the discounted time

Parking eye are part of Crapita, like the Bailiffs Equita and Ross 'n Robbers, is the RK normally resident at the address, and the car registered there? If not it might be private land. Have Crapita Parking Eye obtained a CCJ, were they aware the RK is in jail?

It's just gone to court so there's not an outcome yet I just thought the sooner the keeper on the log book is changed the better. But yes the RK named on the parking tickets lives at the address. The car will have a new RK with a different address but will stay on the drive at the old RK address named on the tickets. . Basically the car will have a new owner and new address on the log book but will stay on the drive of the old address.
No parking eye have not been informed that the. RK is in prison

Ah, had not realised it was so close. In that case transferring Keepers may not work as it could be seen to be done to evade enforcement. The vehicle needs to be moved. Of course PE may not win.

Problem is defendant is in prison, so can't or doesn't know how to defend. Definitely as per PT vehicle needs to "disappear" from the address for now.

The car has been moved but my intention was always to put it in my name and use it as a 2nd vehicle as I have dogs. I didn't do this when all this started and am interested to see if I can still do it but for now the car is safe
