  • esa assessment done, awaiting decision what now? any important steps in the meantime?

Hello thanks for all your help. Assessment has been done, and we are awaiting outcome can anyone offer us any advice in the meantime? The assessment took place on Tuesday 10th, his benefits were paid the following Tuesday? Does this mean that everything’s ok? And were just awaiting the official letter confirming that esa will continue? At the assessment we took much evidence, solicitor’s letters, a strong doctor’s letter and other accompanying evidence.

If people remember we complained to Maximus as there was no esa50 form filled in. The advocate that went with him protested strongly, first via a phone call and then at the appointment. He handed in a document/ complaint stating that the assessment was attended under protest for the reason that no esa form was sent or filled in and that the ‘client’ attending would be at a severe disadvantage due to this, signed by advocate and also the person.

What/is there anything else we need to do in the meantime? I.e. gather more evidence etc Weirdly (according to the advocate and him) the assessor didn’t ask questions relating to the descriptors too much in their opinion. Also weirdly allowed the advocate to speak a lot on his behalf. As he was nervous, and the nurse allowed him to speak via the advocate? i.e he spoke to advocate and advocate then spoke to nurse. We were told this would not be allowed and researched online and found this wasn’t allowed also?

The claimant will eventually receive notification of his status (miraculously cured or still on ESA).
Until then ESA will continue to be paid.

The only thing to do whilst waiting is to request a copy of the assessors report.
This could be useful if an appeal is necessary, or for future assessments.

Some assessors seem to realise that if they don't allow the claimant's supporter to help, there is no way the interview will be conducted within the allocated period.
They insist there are no time limits, but in that case how do they schedule their appointments?

ahh. thank you for your help but we have no been advised to do the following in the meantime in case the decision goes against as it usually does to begin with.. can someone comment. the person seems an expert in this area? what are all these codes? thanks des (again!!!)

      advice given :-

I would put in a SUBJECT ACCESS REQUEST now unless one has already been done
      • The ESA85
      • ESA85S
      • ESA113
      • LT54/ESA65
      • All the paperwork the HP used to get their opinions from
      • All the paperwork the DECISION MAKER used to make their decision from field(s) of expertise
      • The GMC/PIN or other number of the HP who carried out the assessment
      • All qualifications of theirESA85

      • The name and number plus field of medical expertise of any person the decision maker asked for help in making the decision

All the claimant has to do is email their local office HERE with the title SUBJECT ACCESS REQUEST

        ESA 65 is disallowance form
ESA113is medical form compleed by GP
LT54 internal form for referring a case to a decision maker (not normally released to customers)

Just heard via PM that assessment resulted in Selfless' friend being placed in support group.

          No need for appeals!
