  • Acenden charges and more threats of repossession

Having been in the clutches of "preferred", "capstone" and its other name " Acenden Since 2006, We have yet again fallen foul of their ways of making money. We fell into arrears, of our interest only mortgage in 2011, largely due to the ever increasing Libor rate. We were advised to declare bankruptcy which did not help matters. However now we are being taken to court for arrears, despite them decreasing, with a view to repossession. We set up a repayment scheme with Acenden for £1200pcm on the first of each month, however on the 1st nothing came out, so I paid it via their website. Low and behold the presented the DD two days later and it was not honoured- I had already paid it. I contacted the office and the guy ( he gave his name as Jay) apologised and checked that the system was geared up for 1st of next month. Between then and the next payment I received a letter of default with additional charges.....I contacted the office and went through all this again to be assured that it was OK reimbursement was to follow... This happened again and the charges have not been reimbursed and now I have a solicitors letter advising court action. This is just a tip of the iceberg with regards to dealing with P/C/A whatever company this is and despite efforts I cannot swap mortgage providers because the costs to get free are so prohibitive. Advise please:tinysmile_cry_t:

How large is the mortgage? how large are the arrears? when does the mortgage end? how large are your contractual monthly payments?

How much is the house worth?

Do you have unsecured debts as well?

      Did you go bankrupt?

I wonder if this is similar to my situation too - my second mortgage ended feb 2011 but was an interest only payment option as we were selling house. Sale fell through and Top Ups who were, we thought, part of GEMoney, as there rep said when we took mortgage with them that GE's sister group would do top up to get us the full amount we required.

Top Ups did not contact us until 2012 saying they missed the end date but now wanted their money but quoted £36000 as we had paid £4000 in unscheduled payments. We asked for time they agreed if we kept making payments but then put amount owed back to £40000.

Cutting to chase - they sold debt on to Alev in july 2015 we kept up payments to date and by our reckoning we have paid around £18,943.74 to Top Ups since avtual agreement ended and £6200 to Alev since they took it over - should this not have been seen or counted as teducing the debt?

Help please as desperate to know how to sort this.

        J
