    HI,

    I am a new member and just wanted some help.

    About 4 months ago I received a letter from Arrow Global stating that they had bought a debt previously owned by HFC BANK, I thought this debt was statue barred but it was not as I did make contact regarding the debt to HFC in 2013. The debt was originally taken out in 2006. In October 2016 I received a letter from Restons Solicitors acting on behalf of Arrow Global saying that they were taking me to court for this debt of £1,500. After reading some posts on Legal Beagles I used a template letter asking them for copy documentation. I received a letter from Arrow Global in November 2016 saying they were dealing with my request. The court action has now been stayed as it has gone past the date for Arrow Global to provide the credit agreement etc. I have heard nothing until this morning when I received a letter from Arrow Global stating the Office of Fair Trading deems "reconstituted agreements acceptable for situations where an original copy is unobtainable" and they go on to say "In December 2009 the High Court ruled that a true copy of an agreement does not need to be a photocopy or an exact copy of the original. A creditor is allowed to provide a reconstituted agreement, as long as that version is accurate and contains all the original information contained in the agreement." However the copy they have provided me is illegible as the font size is too smal to make anything out. The writing on it is certainly illegible.

    Is there anywhere I can go from here?

      Good morning,

      The letter from AG is a very old template the OFT is long gone and the FCA is now the regulator..

      It would help us to advise you correctly if you can post the document received after removing any personal data.

      For a " recon" agreement to comply with a CCA request it must have the following constituents.

      1. Your name and address as it was when the account was opened.

      2. The original creditors name and address when the account was opened.

      3. The Terms & Conditions relevant when the account was opened.

      4. The T's & C's relevant when the account was closed.

      5. Any other document (s) mentioned in the T's & C's.

      There should also be a signed current statement of the account.
      The " agreement " must be easily legible in all parts.
