    No distance seller is entitled to charge a "return fee", as a matter of law.

    True it is, that as a matter of law, a distance seller is entitled to charge the direct cost of return, but its conditions must expressly say so, again as a matter of law, which leads to the unfortunate result that JD Williams is not entitled to make any charge for the return of its goods.

    I have returned things and never been charged and this from their site

    If for any reason you want to send back something you have bought from us, you can return it free of charge, in as new condition within 14 days of receipt.

      Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 consumers have 14 days cooling off period for changing their minds. There are some exceptions to this such as bespoke items. A distance seller is entitled to charge the direct cost of return, but its conditions must expressly say so. JD Williams's terms describes the charge it makes for using one of it's retained carriers to return goods, as a "return fee". It's practice is to quantify that in the amount it charged the consumer for delivering the item. So, the legal issue is: Does JD WIlliams have a remedy at law, in the event that the consumer refuses to pay that charge?
