  • Tribunal Advice Please

    Hi there I am currently representing myself at tribunal.

    After a preliminary hearing i was requested to submit an application to amend the ET1 3 weeks following the preliminary hearing

    I submitted my application to amend on time and posted a copy to the respondents solicitors (via recorded delivery)

    The respondents solicitors then where to submit in writing any objections 3 weeks following the date of my submission

    The respondents solicitor then wrote to the tribunal asking for an additional week extension as they claimed not to have received the copy i posted and only discovered I had submitted it when they made an enquiry to the tribunal.

    I responded advising them the copy was signed for at there office and provided them with the tracking number, however as the extension would not impact the next scheduled hearing date i had no objections and the tribunal agreed to the extension.

    The deadline for them to submit there response was yesterday and I have received nothing via post or email, I intend to verify with the tribunal tomorrow if they have submitted it to the tribunal and not copied me in.

    My question is, can I now object to their arguments against the amendment on the basis that a large legal firm failed to meet a deadline that had already been extended? If so how do i go about that, would I need to make an applicatoin to the tribunal to strike out there objections/response on the basis they are late in submitting it.

    any help at all would be fab!
