    they told her point blank they were coming out the next day to force entry and took no notice of her plea,they did not tell her they would need a judge to sign of on a warrant to force entry.
    Firstly, given that this fine relates to failure to pay for a train ticket, I was surprised that the amount demanded was so little !!

    Unfortunately, train fine fines are governed by very old railway bylaws and can be exceptionally high with figures of £500-£600 for the fine alone. In this particular case, the fine was approx £200 (which is very low). Bailiff fees consist of a Compliance Fee of £75 and an Enforcement Fee (visit fee) of £235.

    On your second point, I'm afraid that you are wrong, A Judge does NOT need to sign a warrant (permitting the bailiff to force entry). As this is a criminal court fine....no prior permission is required.

      That sounds as if he's there most days, he has keys to the house and is permitted to come and go as he wishes whether mother is at home or not. And, he himself gives this as his home address. I can understand why the bailiffs were not convinced.

      Mother should probably have given them his actual address and/or refused to pay the fine on his behalf. But she chose to pay, and unless there's some way to prove duress I can't imagine any complaint succeeding.
