    This message is on behalf of my husband. He has been suffering with depression on and off for a few years and recently had an unfortunate turn. He self certified for a week on sick and in that week decided his best course of action would be to hand in his notice, for his own health. He handed in a weeks notice and also a weeks sick note. His employer is now saying he is not entitled to his last week sick pay (she has paid for the first week off sick only). He also has only taken 5 of his 15 holidays that he's entitled to since April of this year (the amount stated on the government website) his previous employer is telling him he is not entitled to anything further and that it is out of her hands as his P45 is in the post. She has also told him to 'go away' and stay away from his previous job. I am concerned as we are expecting our 3rd child in 5 weeks and he is the sole provider for our family. I just want some advice and information as to what we should do next. My apologies for the length of this post. He has started a new job but that wasn't within the notice he had given.

    Hi Mandyt1985 and welcome to the forum. There are some things that I can advise you on however I need to ask a couple of questions first:
    How long was your husband employed at that company?
    What is the company's sick pay policy in terms of paid sickness absence?
    Contractually was he required to give a certain amount of notice if so what was that?
    What was his provision for holiday? From what you say is seems that his holiday entitlement was 20 days plus bank holiday if so were bank holidays part of his normal work pattern or did he have bank holiday days off?
