    Hi

    Today I have received a letter from Capquest about a Citicard from around 1993, owing £2100.00 I have checked my credit file and it doesn't show anything and I have no details/knowledge of a CCJ if one was ever issued.

    Can you please tell me how to proceed from here?

    What does the letter say ? Does it say there is a county court judgment in place and they are threatening enforcement or are they simply asking for payment of the debt and threatening future legal action ?

    Do you have any idea at all when you last had anything to do with the old Citicard ? Sounds like it could be over 6 years ago if it's not on your credit file, but it is best to double check as sometimes debts show on one credit file and not another.

      Hi

      It says the following

      Ownership has now been transferred to Capquest and they will be managing my account, they want to work with me to get on the road to financial recovery,

      They want me to contact them to make the journey as easy as possible, and they would like to work with me to get a plan in place that suits my situation.

      I have checked on Noodle and the free on that Martin Lewis has which is Experian and there is nothing on either of them, I think the last time I made a payment was about 1995.

        Okay in that case you should be able to see them off quite easily with a letter telling them the debt is statute barred.

        You can amend this as needed

        Re: Account No/Your Ref:

        No debt is acknowledged to your company yet you have contacted me regarding the above account.

        As I am sure you are aware, under the Limitation Act 1980, s.5 “an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued.”

        No correspondence/payment/acknowledgement of this debt has been made within the last six years and accordingly unless you can provide evidence of payment or written contact from me in the relevant period under s.5 of the Limitation Act 1980, I suggest that you are no longer able to take any court action against me to recover any alleged amount claimed.

        Furthermore, the FCA Consumer Credit Sourcebook (section 7.15) states that "Notwithstanding that a debt may be recoverable, a firm must not attempt to recover a statute barred debt in England, Wales or Northern Ireland if the lender or owner has not been in contact with the customer during the limitation period." and that ''A firm must not continue to demand payment from a customer after the customer has stated that he will not be paying the debt because it is statute barred.''

        I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.
