    Tax credit overpayment & credit file


    Hi,

    Please can anyone help. Sorry if this is wrong thread. Guess this is 3 questions in one so wasnt sure where to post the thread...

    I've been disputing an overpayment of tax credit since 2010 but every year I have received another request for payment but giving no answer to the original dispute, I even had their customer service members tell me its a standard letter so take no notice. I keep highlighting the issue and they say they will look into it but still havent had any reply. This is now over 5 years...

    My question is in connection with credit file. I'm getting to the point where I want to just pay the amount(even tho I dont feel I was in the wrong) as worried of this debt hanging over me and effecting my credit file. I even had an issue where they past it to a debt collection agency in 2014, without telling me and then they had to apologize as it was an error but even tho it had been past to a debt collector nothing showed on my credit file.

    Can HMRC Tax credit get passed to a debt collector without it showing on your credit file?

    Can tax credit overpayments show on credit files, as a default for example? or are they treated differently to loans, credit cards, bank accounts etc....?

    If it can be treated as a default, if the original date of overpayment is from 2010....would it be that date that was shown?

    Sorry for all the questions.

    [MENTION=48934]Debt Camel[/MENTION] should know better than me (I've tagged her) ... but I believe that TC overpayments will not be shown on a credit file. Wait for others to comment tho' xx
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      Hi Kati, Thanks for your comment and for tagging Debt Camel........starting to get me really worried as my credit file is almost clear since my bankruptcy 6 years ago...the thought of something new showing would be horrible and very upsetting!

      As Kati has said, If anyone else could confirm above comments, I'd really appreciate it! Would give me more confidence to fight for what I feel is right and not just give in to the worry/pressure

          Thanks again Kati......I think the panic sets in because its taken me so long to start repairing my credit file after bankruptcy...After having nightmares for many years, I'm almost there and just starting to see "light" at the end of the tunnel....

              Just as an updated....Spoke to tax credit again this morning about the overpayment...since my June 2015 conservation with them, they havent even looked at the case(again). Thats now 6years (in Oct) and no one has even investigated my original dispute from 2010! I havent had any demand letters in a while so thats a good thing but as I learnt from the past when I was made bankrupt over 6 years ago....its best to tackle these things head on and not brush them under the carpet. They havent even decided if it needs paying yet.....Dont these people have internal guidelines for their service standards? Surely after "almost" 6 years and no one has still investigated a dispute, you'd think it would be written off? One side of me says I not paying it and will keep fighting because of the mess they are causing but the other side of me just wants it done and finished....

                a tax credit overpayment will NEVER show on your credit file. It doesn't make any difference if it is with HMRC or passed to a debt collector.

                I don't know what grounds you have for disputing the tax credit overpayment. Or whether you have been putting your request for an explanation / objection / complaint in writing every year.

                  Hi, thanks for your reply and for confirming tax credit overpayment doesnt show on credit file, last thing I need after 6 years of keeping it clean, is something like this showing up! Dispute was opened in 2010 (I completed a TC846 form) and they confirmed in writing that they were investigating the dispute. This dispute is now 6 years old and no one has even opened the case to look at it. My dispute is 2 fold really...first is the amounts they quoting, just dont add up and also whether this should be included in my bankruptcy, as both happened around the same time.

                  Dont have any issue with paying back any overpayment but after 6 years, to be told (yesterday) that no one has even looked at the case, just blows my mind.....

                    OK, then in that case I think you should put in a new TC846 and this time your complaint is about the time it has taken to resolve your previous complaint.

                    If you don't get a satisfactory answer after 3 months, contact your MP!
