    Well, that's debatable since it's not really been hashed in court, but they do it anyway knowing that alot of consumers panic and end up paying in the end, though the default will stay there anyway for 6 years so its a loss for the consumer and a win for the lender.

    I have only just realised that my old finance lender has applied a default and marked the account as partially satisfied instead of settled, so if they don't come back to me and have it amended immediately then I am likely to go to court for breach of data protection. It was initially settled but at some point they have changed it and applied a default though I am not sure why though I am confident they will amend it.

    It is up to you though how you want to go about it, many people on here have a little moan but ultimately pay up when it gets a bit more serious and there's no problem with that but if you are going to do it, I would say do it not before they put any adverse marker on your file.
