  • Help with aa defended claim

    Hello,

I need some help regarding having received from a defendent an incomplete N9B Defence & Counterclaim Form. On this they deny owing me the money but have failed to complete the reverse of the form with their details (Name, address, Date of Birth, Signature etc. The time for them to have filed a defence has now passed (though they issued the incomplete form in time). Can this incomplete form be deemed as ineffective regarding responding in time ie can this be rejected as a defence served in time? If so, what should I do, simply approach the issuing Court?

    Any help appreciated

    Thanks

My feeling would be to return the form to the court having completed your part, the court will then deal with the response.
It is not your responsibility to correct the other parties errors.
