    Hi All,

    I am not sure if I am posting this in the right section so please feel free to move.

    I have three defaults on my credit file - all from various Lloyds products and all with default dates of around Feb 11 so will be coming off my credit file soon. I was young and stupid and just ignored these debts for the last few years but now I have come into a little money and could make full and final offers on these debts. My problem is I haven't been chased on any of the debts for ages so have no idea who the debt is actually with at the moment - I am also not sure if they have my current address as I know I haven't given it to them. I have been in my place for three years and am on the electoral roll if that makes a difference...

    Does anyone have any idea how I could go about getting in contact with the DCA without admitting the debt - cos I am worried this will reset the statute barred clock - as I am pretty sure if they aren't statute barred already they will be very soon. I don't want to just leave it because I am worried about them issuing proceedings at a previous address and I will not have a chance to enter my defence.

    Sorry for the long post - any thoughts would be greatly appreciated.

    Have you checked your credit file (Noddle is free)?? Any defaults etc... should show up on there
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      Hi thanks for your quick response.

      I have checked all CRAs and defaults are shown. Two of them just say Lloyds and the third looks like it has been passed on to 1st Credit.

      Is there any way you can think of that I can initiate contact with them without admitting liability - I understand that's a bit of a strange request.

          Good morning cockneygirl,

          A full and final payment ( less than the actual balance) will get a " partially satisfied " marker which will stay on the credit files until sometime in Feb. 2011. Paying off a debt completely will get a " satisfied" marker.

          With 1st Credit in particular contact in writing discussing any form of payment will be taken as an admission and that restarts the 6 year Limitation Act 1980 back at zero.

          It's become rather more difficult to get default entries removed as the Information Commissioners Office which regulates the CRA's decided that credit files must show an up to date and accurate reflection of the conduct of an account, prior to this one could negotiate a deal whereby an F& F payment would get the entries removed.

          My opinion is leave these alone for now hang on to your money just in case and new contact is made.
