Re: BW Legal & CC Claim Form

No. We may show it to a judge later when we bring up said failures in court or when we are seeking costs. It's more a tactical set up which they'll probably ignore or tell you to piss off.

They tend to treat you as a clueless mug until it dawns on them you are not as easy prey as others then it'll fade away rather than reach trial with a bit of luck.

      Thank you
I'll post the letter to BW Legal recorded and the Court Claim back to Northampton also recorded.
Do I need to keep an eye on dates?

Re: BW Legal & CC Claim Form

Email is better as it's free and harder to say it went missing.

Yes keep an eye on dates. 5 days for service + 14 and 14 more if you file acknowledgement of service. Total of 33 days from the date on the claim form to lodge a defence.

7 days at most or if the deadline for filing the defence is 7 days or less away.

It's been a week and we have heard nothing from BWLegal
Am I best to email them asking for the requested info and give them a deadline as I need to submit a defence?

Re: BW Legal & CC Claim Form

Phone them up on Monday and ask if they got it, why they haven't replied and if they intend to correct their errors.

Get an email address and confirm details of the call to use as evidence you tried to get them to proceed correctly.

Re: BW Legal & CC Claim Form

Finally got through this evening Spoke to a lady called Beth (They don't give surnames out)
Still no response from letter emailed on 5the and then again 16th.
Told litigation department closed and only work 9-5 as per the courts.
I'm getting very concerned what happens next as no one has confirmed extension to 28 days has been agreed and original letter was dated 29th July. Should I be concerned or should I notify the court of lack of response
It feels like they are delaying in the hope we will just pay!!

Re: BW Legal & CC Claim Form

I will get a defence sorted at the weekend.

You have 33 days to file if you have filed acknowledgement of service. 5 days service + 14 days then another 14 once AoS is done = 33days.

                          Hi
Many thanks for your response, we have today received a letter from BWL confiming receipt of our letter dated 5th Augsut and they have given us until the 14th Sept to file a defence and we should up date the court
I spoke with their Litigation department today who state they have complied with the civil procedures and no further information is legally required to be sent to us, unless the court ordereds them too.
I have sent Kati an email with a copy of the letter.
The gentleman i spoke to today has requested a copy of the original PCN as we did not receive it as they didn't get the right surname and it is only our recent Postman realised the letters could be ours.
Once again thank you for all your help with this matter

As time is nearing the 33 day limit i'd edit

                              Gemsterdef.rtf

Then file it with the court.
