    I have received a claim form from Arrow Global (issue date 14/07/16) concerning an alleged £970.91 debt to RBS (East store card). The particulars of claim state that the debt was assigned to Arrow Global 15/12/10. I dont have a notice of this assignment. It also states that I have failed to make payment in accordance with the agreement and a default notice has been served under CCA 1974. I dont have any default notice. Arrow Global did send a letter sometime in June. Nowhere did it say it was a letter before claim. I ignored it because I believe I sorted out my debts through individual agreements with my debtors in 2009. I do not have any memory of when or how much was paid on this account or when I last heard from a DCA concerning this debt.
    I have returned an AOS but have no idea where to start with a defence. I would like them to prove this debt is owed but do not know what papers to ask for. My job would be severely compromised with a CCJ, although I work part time with meagre earnings. I have no assets or savings; I suspect I would just pay them to go away if I did.
    I would be really grateful for any advice on this matter. Thanks in advance.

    Good evening, welcome to LB.

    The first thing to do now you have acknowledged service is a request made under the provisions of Section 78 of CCA 1974 for a copy of the agreement relating to the alleged debt (CCA Request). There is a £1.00 statutory fee for this, use a postal order for this marked " For Statutory Fee Only". Use the template in the green box at the top of the main forum page. Send by signed for post.

    Next a request made under the provisions of Civil Procedure Rule 31 .14 (no fee) this goes to the claimants solicitor ( who are they represented by?)
    Template in Green Box. This is for the documents specifically mentioned in the Particulars of the claim only do not request anything else.

    If you can please post a copy of the claim form (N1) after removing your name /address and the claim number please leave all else intact.

    Also please give us the history of the debt, when was the account opened, when was it defaulted/terminated? When was the last payment or written acknowledgment made?

    Hopefully with the information requested we can advise further.

      Thank you so much for replying. I will send a CCA request and CPR request tomorrow. I have no idea when the account was opened but possibly around the end of the 1990s. I dont know when I defaulted on the agreement. I had a lot of debts around the time. The debts were passed around various DCAs but I made repayment agreements to the best of my knowledge with regards to all of them 2006-2009. I do not know when the last payment was made to them. I do have old bank statements but do not know who had the debt before it was taken over by Arrow Global. This is why I would like to see all the papers they have in relation to the debt. Shoosmiths are the solicitors. Is it possible to scan the claim form otherwise where should I post it. Many thanks again for you help.

                            Hello I have not had any of the documents I requested from Arrow Global sent to me. The claim form was issued July 14th; date of service taken as 5 days after issue. I make August 17th as date defence has to be submitted. Should I ask for an extension? Should I recontact Shoosmiths? Can I do this online? Thank you very much in advance if you are able to help me with this.

                              Yes you can ask for an extension But you will be giving them more time to recover the documents.

                              Have the requests been acknowledged?
