    Hi, I've hopefully put this in the correct section and am looking for some help if possible. I've read through some threads and you guys seem to know what you're talking about.

    I have (probably wrongly) been ignoring letters about these 2 amounts owed through advice from a friend that they are close to being unenforceable. However, I received these 2 letters yesterday and thought I can't really just keep ignoring them and hoping they'll disappear.

    One is a bank account with an overdraft. I had the account since I was a child and got the overdraft through applying online and increasing it (stupidly) myself when I was young and stupid. I think that will be the £2,506 one although I'm pretty sure that must mostly be fees or something because I definitely didn't have an overdraft that high.

    The other is a Credit Card I also applied for online when I was young and stupid.

    I don't have other paperwork regarding these debts, this is all I have. I have put a screen grab of what Noddle say about each onto the letter document, if that helps.

    Do I need to send them letters? Which ones?

    Thank you for any help. I'd just like to put this all behind me and move on with my life. The stress is not doing me any good.
    Hopefully the files have attached correctly and are readable.

        Send a CC1974 (Copy of Application form) request, see if they can supply an Enforceable one for the Credit Card, with a Postal Order for £1.00, written on reverse for CCA1974 request only.

        Overdraft etc when was the last time you acknowledged the debt i.e. within the last 6 years?? or corresponded about the overdraft?

        in fact regards the Credit card as well?

          I don't think I've paid anything to or acknowledged either since the end of 2010. I stopped doing anything with both at the same time so I'm not sure why the overdraft one (which is the higher one, made a mistake before) has a much later default date?
          The overdraft one is almost 3,000 but my overdraft was nowhere near that amount. Pretty sure it was 1,000 possibly 1,500 but no more than that. It must be tons of fees on top.

            If so they're not statute barred yet anyway. Can you check your dates for accuracy?

            It will depend on the date when they were officially terminated. (This may also affect whether either/both are SB)

            Yep. Fees plus interest.
            The letters contain a lot of 'may do X, and 'being considered for Y'.
            The default dates you refer to seem to be obtained from a credit reference agency. While being a useful indicator, they do not necessarily reflect the actual date the accounts were terminated.
            Do you have any historic records of the debts? If not, you need to obtain them.
            It is likely that Hoist will not have documentation at the moment; they will probably need to go back to the original creditor for them.

              I don't think either are SB yet, just possibly close. This is what my friend told me and said to just ignore because soon they wont be able to do anything.
              I don't have any historic records, all I know is I opened a new account at HSBC when I stopped doing anything with Lloyds so I have that date to go by which is December 2010.

              How do I get records?
