    I agree with Charity that a CCA request sooner rather than later is a good move if your aim is to prevent a claim. Maybe send it in reply to their next letter.

    Is this debt likely to still be under £3k? You said it was £2.3k in 2013 but might have increased if interest has been added.

    The Scottish legal system is different from the rest of the UK.

    Here's some information as to how things work if you do get a claim but you don't need to worry about that yet. If they can't find the appropriate paperwork then they will have to think carefully before issuing proceedings >

      I got the interest froze a few years before that. Will the CCA request not be an admittance of the debt.

        No it won't.

        But don't change any of the wording in the template letter apart from adding your personal details, the date etc.

              we would ask you to let a team member see what they send as a lot of what is said is suspect etc do not panic, you are are in good hands on here.

                  I was phoned last week by someone with an English accent and I gambled and said you have the wrong number who is calling. She said Cabot financial and I repeated it was the wrong number. They haven't called back since but I have recieved my first letter. Not much in the letter, it's just mentioning personal payment plans and what could happen if you don't talk to us. Your credit file may be affected by the amount you owe, we may have to consider other ways to recover your debt, You will recieve calls or letters until you contact us and the outstanding amount will remain due.

                  Probably a standard first letter.
