    My cousin died intestate. Heir hunters found 8 first cousins - 2 on her fathers side and 6 on her mothers side. How is her estate divided - equally between all 8 cousins, or equally between the fathers side and the mothers side?

    If there are no parents, children, siblings, aunties etc surviving and the 8 first cousins are surviving, then yes the estate would be divided equally (per capita) between all 8 cousins.

    Things are only divided 'per stirpes' if there are different levels of relation to inherit ( ie. if a first cousin had died then their children would inherit their parents share divided equally between them)
