Can anyone help with TUPE law please.
I worked for a company for 4 years and over 100 people were TUPE'd to another company, however had we continued to work for the original company we would have received a bonus payment. Obviously because we transferred to a new company we did not receive anything. Three people who were originally on the TUPE transfer list who managed to secure other jobs with the original company received the Bonus payment based on the profits that were made by us all.
Also we did not receive the mandatory 90 days notice for the TUPE transfer. Had we received the 90 days then we would have still been employed by the original company at the time the Bonus was paid.
Do you think we have grounds to take this previous employer to a tribunal ?
