  • Employment tribunal fee q

    Hello,

I have followed the ACAS early conciliation process, with the Employer unwilling to attempt to conciliate, resulting in me now making a tribunal application, Being on Uniceral credit, how do I make the application when requesting help with fees under the fee remission..... Do I pay the fee online when doing the application and then send the form in to claim the funds back? Or is their no fee to pay online when doing the application? Help would be appreciated please, thank you

If you are requesting fee remission then you do not pay the fee when making a Tribunal application. You make sure you tick the box on your ET1 form which states “I enclose an application for remission of the fee”, it will be accepted that the Fees Remission form is included even if posted / emailed separately. If you don't tick this box your claim will not be accepted and will be sent back to you. You may have to provide proof of earnings / savings / bank statements along with the fee remission form.

I am not a solicitor and am only speaking from recent experience. I used a number of reference sites but found this Legal Beagles site and Employment Tribunals UK to be most informative.

Be aware the employment tribunal could make you pay the employer's costs of his lawyer's time worth several thousand. Think carefully about it unless you have a good case against your employer.
