  • Tribunal Judgement and Reasons

    I am hoping someone can advise me as to what I can do to get a response from the Employment Tribunal.

    I submitted a claim in April 2013, which was not heard until February 2015, closing submissions were in May 2015. Now here lies the problem, I had continuous delays in receiving the judgement and written reasons until the judgement was eventually issued in March 2016 as a result of y continued queries. I have been requesting a timescale for the written reasons since then but had no joy, my e-mails were ignored and when I telephoned and was advised I would be called back the same day, it just didn't happen.

    I am perplexed as to how I lost the case but it would appear I am being given the run-around as to the issuing of the written reasons - I just feel as a litigant in person, this is further evidence of being treated with contempt as a result of having no legal representation.

    Where do I go next - any advice?

    hey there Angelica, sorry to hear you lost your ET claim. Did you do an early conciliation at first with ACAS, assuming you did what did they recommend. Moving on to the ET, what did you lose on in particular? I am not sure if the ET has duty to provide you with reasons but would expect it to do so anyway, so if there are any issues in terms of points of fact or points of law that you think of to raise these at the correct forums. I do know that there are deadlines for either or though. Was a costs order issued against you (hopefully not)? You can in general ask the ET to consider a point of fact via a reconsideration. If you want to continue, you can only make an application to an Employment Appeal Tribunal based on a point of law. Apparently, very rarely are the EAT appeals successful.
