  • Need some advice please.

    I had a car accident 12 months ago - May 2015. I was parked up as there was a cow loose on the road. The lady in front stopped. I stopped. We were just over a blind summit. A lady came up the hill doing about 60 and slammed into us. We then slammed the lady in front. I broke my back, my ribs, lost 2/3rds vision in one eye and four of my front teeth, whip lash. My insurer put me in touch with a firm of solicitors straight away and the lady who hit us admitted liability immediately. It took until August for the lawyers to get me to see a doctor for assessment. He made recommendations including a further MRI, seeing a pain management specialist and a spinal surgeon - only the MRI has happened yet he promised it would be quicker than the NHS and my GP agreed. I have had to give up work. My husband is now part time as he needs to be around for me as I can't effectively cope with the children on my own, drive etc. The lawyers I had initially went bust and were taken over by another firm. I had the MRI and the new lawyers suggested a spinal surgeon in London but it has been 3 months since that suggestion, none of the other treatment suggestions have been actioned. My GP has asked for the MRI scans but had nothing back and she won't expose me to further radiation. Their excuse is the company they use to organise the health side of things is coming back to them but its difficult to get through. I asked for an interim payment. I have no idea if they written to ask for one or not. I have lost very nearly everything - including my company and had to put 4 members of staff out of work.
    I am at the top of the drugs tree for the pain relief my GP can prescribe. I am in constant agony and she has now resorted to giving me morphine and valium so I can knock myself out whilst the pressure on my spine subsides.

    What can I do? I have written to them today to ask for the info we have asked for an appointment for the spinal chap within the next 7 days or I am changing lawyers and taking action against them for negligence. Is this possible? I am so completely fed up, on anti depressants as I feel like such a burden to everyone and I have to face the woman who did this as she is a mum at the school.

    In fact, if you contact a firm of reputable solicitors they should be willing to take over your case and do all the work for you, including advising you how to lodge a complaint.

      Also advise your insurers that the firm they introduced you to are pants.
      Was this introduction because you had Legal Expenses Cover?

        Hi,

        They didnt introduce us to this one. They introduced us to another one who subsequently went bust and this lot did the buy out. The first lot were awful - this lot, if its possible, are worse.

        Its no win no fee.

        Where do I go to find a firm who are ok? Both firms seem to have high client numbers and low staff numbers. The first lots claim handlers were in south africa and had no idea what was going on. This new lot work on a one email a month basis I think as that is all you get if you are lucky - minimum work optimum fee I suppose.

          Better you find some other reputed personal injury law firms. I had the same situation like this. It happened 1 year back. I was not able to walk at that time as I had some problems with the spine. I couldn't able to do anything on those days. And the case was really hopeless. I lost the trust on that lawyer. With the help of my brother I could find 3 months back I could get the claim money. Now I have done with my surgery and getting back to my normal life.

              Not sure if you still need help with finding a solicitor but I would highly recommend the Association of Personal Injury lawyers (APIL) website. All decent personal injury firms are members of the Association and the training is first class. Their website is www.apil.org.uk.
