  • Statements / Notices of Sums in Arrears

I am interested to know if anyone has successfully tried to argue against the debt collection agencies on the basis of them not having being provided with statements and notices of sums in arrears. I used to work for a debt purchasing company and this was by far their biggest concern - huge debt portfolios that they have purchased where the debt is unenforceable because statements / NOSIAs had not been served as required by the CCA. The situation can be remediated by the debt owner but often the debt is so old and been sold on a few times so the debt purchasing companies won't have the information to do so.
