    can any one help please?
    half way through my 14 day cooling off period , the estate agent sold our house subject to contract on day2. we have now decided that we dont want to move can we get out or is it too late?

    If you haven't exchanged contracts you are able to pull out

      You may still have to pay the estate agent as he has performed his part of the contract.

        From my understanding of this, if you allowed viewings within the 14 day period, that meant that you agreed the agent to commence marketing. You should have a contract that defines this very point but I believe that under your circumstances, the agent may be able to charge a fee proportional to the work completed to date, which if you think about it is probably quite fair. The argument that may then ensue concerns what is proportional and fair.

        But check your contract!

          Always understood it was no sale no fee until the buyer and purchaser have created a sale by completion surely the agent gets nothing after all something is on Sold when its paid for an agent introducing a buyer whom may at anytime withdraw is not a sale

            You can pull out but you would have to pay the agents fees, but your not comitted to the purchaser in any way, just the agent, you owe them , but you could try negotiating them down

            you say it sold within 2 days, ( maybe they had someone looking for property in that area ) who set the sale price ? Can i ask, did you feel under presure at all to put this up for sale with the agent by there sales
            crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

              by the sounds of it i could be court for some form of costs either way is it best to go along with it say that were looking but not found and wait for the buyer to pull out then cancel?

                All depends upon the contract. If you haven't exchange any contracts with the buyer, or you didn't buy any advance amount, there won't be any issues. You can come out of this deal. But you will have to pay some amount to the agent as his broker fees.
