  • Is this breach of Data Protection Act 1998?

    Hi all,

    I work for a well known bus company in london. reacently my manager used my driving licence number and my full name to check on the transport for London website if I own a mini cab licence (PCO) without seeking my permition to use my details on a public website.

    My question is whether or not he breached the data protection Act 1998 by doing so as he had no consent from me to use my details and if he can discipline me for having the PCO licenece even thou I do not work as mini cab driver.

    It depends if or not your employer provided you with what is known as " fair processing notice" on how your employer will use your personal information.

      Fair Processing notice was never provided and this checks are only conducted by one manager at the company.

        I would contact the ICO and ask them for advice and they will tell how to make a complaint under the DPA. Their Information line Tel Number is 0162 554 5745
